Balanced You Buyer’s Club provides you access and use of our website and social media sites operated by Balanced You Buyer’s Club (collectively, the “Sites”), subject to your compliance with these terms and conditions of use (the “Site Terms”). By accessing, browsing, and using the Sites, you agree to be bound by the Site Terms and all applicable law. If you do not agree to be bound by the Site Terms and applicable law each time you use the Sites or you do not have the authority to agree to or accept these Site Terms, you may not use the Sites.

 

A. Related Policies and Terms

Additional policies and terms apply to use of specific portions of the Sites and to the purchase of certain Merchandise or Services and are included as part of the Site Terms. The Site Terms apply exclusively to your access to, and use of, the Sites and do not alter in any way the terms or conditions of any other agreement you may have with Balanced You Buyer’s Club for products, services, or otherwise.

B. Modification of Site Terms

Balanced You Buyer’s Club reserves the right to modify these Site Terms in our sole discretion from time to time and only Balanced You Buyer’s Club has the right to do so. If the Site Terms are changed, we will post the new terms on the Sites and note the date they were last updated. Any changes or modification will be effective upon posting of the Site Terms as revised, and your use of the Sites following the posting will constitute your acceptance of the new Site Terms.

C. Changes, Misprints, Errors and Cancellations

Subject to applicable law, we: (a) reserve the right to change the goods and services advertised or offered for sale through the Sites, the prices or specifications of such goods and services, and any promotional offers and any other Site Materials at any time and from time to time without any notice or liability to you or any other person; (b) cannot guarantee that goods or services advertised or offered for sale on the Sites will be available when ordered or thereafter; (c) reserve the right to limit quantities sold or made available for sale; (d) do not warrant that the Site Materials (including without limitation product descriptions or photographs) are accurate, complete, reliable, current or error-free; and (e) reserve the right to cancel, to terminate or not to process orders (including accepted orders) where the price or other material information on the Sites is inaccurate or when we recognize abuse of our policies. If we do not process an order for such reason, we will advise you that the order has been cancelled and will either not charge you or will apply credit to the payment type used in the order. Some jurisdictions may not allow the exclusions and disclaimers of certain implied warranties, so some of the provisions of this section may not apply to you. Where required by law, taxes applicable to merchandise you are purchasing will be added to your order.

D. Passwords and Security

If you use a password to access the Sites or any portion of it, then you are responsible for maintaining the confidentiality of the password and for restricting access to the device you use to access the Sites, and you agree to accept responsibility for all activities that occur on your account or with your password. In the event that the confidentiality of your account or password is compromised in any manner, you will notify Balanced You Buyer’s Club immediately. Balanced You Buyer’s Club reserves the right to take any and all action, as it deems necessary or reasonable to maintain the security of the Sites and your account, including without limitation, terminating your account, changing your password or requesting information to authorize transactions on your account. While Balanced You Buyer’s Club takes prudent steps to protect your account and the Sites, it cannot protect your information outside of the Sites. For example, when Balanced You Buyer’s Club communicates with you via unencrypted email from time to time, the communication is not secure, is not stored securely, and the information contained may be viewed by others. You acknowledge that by requesting information by email, you agree that we may transmit it to you from time to time and store it in an unencrypted form and manner. Balanced You Buyer’s Club may rely on the authority of anyone accessing your account or using your password and in no event will Balanced You Buyer’s Club be held liable to you for any liabilities or damage resulting from or arising out of (i) any action or inaction of Balanced You Buyer’s Club under this provision; (ii) any compromise of the confidentiality of your account or password; and (iii) any unauthorized access to your account or use of your password.

E.  Membership Privileges and Conditions

  • Membership is available to all qualifying individuals 16 years of age and over.
  • Balanced You Buyer’s Club reserves the right to refuse membership to any applicant, and membership may be terminated at Balanced You Buyer’s Club discretion and without cause.
  • Membership is subject to any and all rules adopted by Balanced You Buyer’s Club, including our privacy policies and practices, and they may be amended from time to time without notice.

·         Membership fee is for one 12-month period from the date of enrollment of the Primary Buyer.

·         Your membership is valid on the Balanced You Buyer’s Club website and is not transferable.

·         Sharing of Club Membership Accounts amongst different households is strictly prohibited. Periodic checks of IP Address, credit card information, and home address will be done to enforce this policy. You will receive notification of an infraction for your first two offenses and upon the third offense you will be removed from the Buyer’s Club with no refund due to you.

MEMBER'S RIGHT TO CANCEL

·         If you wish to cancel this contract, you may cancel by delivering or mailing a written notice to the club.  To prove that you canceled, it is recommended that you send the notice by certified mail or statutory overnight delivery.  The notice must say that you do not wish to be bound by the contract and must be delivered or mailed before 12:00 Midnight of the third business day after you sign this contract.  The notice must be delivered or mailed to: (Balanced You Buying Co-op, 14 Avocet Way, Savannah, GA 31419).  If you cancel, the club will return, within ten days of the date on which you give notice of cancellation, a total refund.  It is recommended that you mail the notice of cancellation by certified mail or statutory overnight delivery, return receipt requested; check with your post office as to the time when you will be able to mail a certified letter.  Be sure to keep a photocopy of the notice of cancellation which you mail.

 

F. Renewal of Membership

Renewal fees are due no later than the last day of the month your membership expires. You may renew online at BalancedYouEmporium.com. Balanced You Buyer’s Club members may charge their membership fees automatically on any Visa® credit/debit card or Mastercard debit card.

  • Memberships renewed within 2 months after expiration of the current membership year will be extended for 12 months from the expiration date. Memberships renewed more than 2 months after such expiration will be extended for 12 months from the renewal date. All renewals will be assessed at the membership fee in effect on the date the membership fee is paid.
  • The Primary Member is responsible for the membership, and must authorize changes, including additions or deletions.

G. Payments and Sales Tax

  • Balanced You Buyer’s Club accepts: Visa, Mastercard, American Express, Apple Pay, Google Pay, Pay Pal, Shop Pay.
  •  Balanced You Buyer’s Club does not accept manufacturers' discount coupons or other retail establishment discount coupons.
  • The Primary Member is responsible for purchases made by any additional household members.
  • The member agrees to pay Balanced You Buyer’s Club any sales, excise, use or ad valorem tax that is imposed on the sale price of the items purchased, which may be based on the price before any discounts or promotions. The member agrees that they will hold Balanced You Buyer’s Club harmless and indemnify Balanced You Buyer’s Club from any claim, loss, assessment or expense occasioned by non-payment of tax to Balanced You Buyer’s Club.
  • If any merchandise is being purchased for resale and an exemption from tax is sought, the member shall have a valid resale license number on file with Balanced You Buyer’s Club. Such declaration, and the products purchased thereunder, shall be recorded on a "Certificate for Resale." Sales tax will not be charged at the time of purchase only on those products the member states are specifically for resale; all other products subject to tax will be deemed taxable.
  • In the event any product that was purchased for resale (tax free) is subsequently consumed or used in any manner other than for resale that creates or imposes a sales or use tax, the member agrees to report and pay to the proper taxing authority any tax due, including penalties and interest.

H. Ordering, Returns, Shipping

·         Orders will be placed once per month per distributor dependent on meeting their minimum order of $250.

·         Member minimum orders are $30/distributor

·         Damaged and/or incorrect items will be credited immediately to the members preferred form of payment.

·         Misordered items may be returned within 15 days. Member is responsible for all shipping and restocking fees.
